Minimum Nurse Staffing Ratios in California Acute Care Hospitals

Assembly Bill 394 (1999) directed the California Department of Health Services to establish "minimum, specific, and numerical licensed nurse-to-patient ratios by licensed nurse classification and by hospital unit." This legislation also limited scopes of practice for unlicensed personnel. AB394 generated considerable attention nationwide. California was the first state to legislate minimum nurse staffing ratios, although ratios have been specified in union contracts at hospitals in several other states. Since passage of AB394, similar bills were introduced in several other states. AB 394 may have a major impact on demand for nursing personnel, the adequacy of nursing supply and the quality of nursing care provided to consumers. Unions representing nurses saw this bill as a means for improving patient and employee safety. Hospitals were concerned that AB 394 would exacerbate the difficulties they face in recruiting and retaining nurses.

Building on the Center's previous work, the California Workforce Initiative conducted research and analysis to inform the development of the minimum nurse staffing regulations; collected information to inform the ratio-setting methodology, looked at "best practices" in hospitals across the state; and convened key stakeholders, including representatives of hospitals, labor unions and professional associations to share research findings and to discuss options for determining how to set the ratios
